Class I – Full-Scope Trust Company

  • Permitted Activities: May offer fiduciary, trustee, and custodial services to the general public (including non-residents).
  • Minimum Capital: US $100,000.00 (can be substituted by providing the RFSA with Qualified Insurance Policy and promissory notes jointly signed by C-Suite or 25%+UBOs).
  • Licensing Fee: US $2,500
  • Requirements:
    • Application with business plan, AML policies, and governance documents.
    • At least one local compliance officer.
    • Audited financials (annual).
    • Subject to ongoing RFSA supervision and reporting.
    • Qualified Insurance Policy

Class II – Restricted Trust Company

  • Permitted Activities: May offer services only to affiliated persons or related entities.
  • Minimum Capital: US $50,000 (can be substituted by providing the RFSA with Qualified Insurance Policy and promissory notes jointly signed by C-Suite or 25%+UBOs)
  • Licensing Fee: US $1,250
  • Requirements:
    • Streamlined application.
    • Affiliation disclosures.
    • Limited AML and reporting obligations.
    • Qualified Insurance Policy

Exempt Trust Company – Notice Filing Only

  • Eligibility: Trust structures that are not actively marketing or offering trust services to the public and only serve up to five family or business groups.
  • Filing Fee: US $150
  • Requirements:
    • File Exempt Trust Notice within 15 days of formation.
    • Provide summary of trust purpose, UBOs, and AML attestation.
    • No prior RFSA approval needed.
    • Must maintain records and remain subject to RFSA inspections if red flags arise.
    • Qualified Insurance Policy
